Current Law on using a hand held phone in a vehicle It is currently against the law to use a phone whilst driving unless a hands free method is deployed. Legislation changed in February 2007 where if you are caught holding a mobile phone whilst driving you will be issued with a £60 fine and 3 penalty points. Drivers of commercial vehicles could see the fine increase to £2500 if dealt with by the courts. This law also extends to who "caused" or "permitted" someone to drive whilst using a mobile phone, such as an employer; they too could be liable to prosecution.
